The protection of personal information is important to Bowls New Zealand.

Bowls New Zealand is committed to respecting the right to privacy and the protection of personal information.

This sets out how Bowls New Zealand may collect, hold and use personal information. By providing your personal information to Bowls New Zealand (either directly or through an affiliated organisation), you consent to its use, storage and disclosure in accordance with this Privacy Policy and the Privacy Act 2020.

What personal and sensitive information does Bowls New Zealand collect?

Personal information is information or an opinion (including information or an opinion forming part of a database) whether true or not, and whether recorded in material form or not, about an individual whose identity is reasonably apparent, or can be reasonably ascertained, from the information or opinion.
The information collected by Bowls New Zealand about a particular person will vary depending on the circumstances of collection.
It may include, but is not limited to, a person's contact details (name, email and/or postal address, phone number), date of birth, gender, credit card details, driver's licence number, passport number, insurance details, employment history, qualifications, or communication history with Bowls New Zealand.

• political opinions;
• membership of a political association, professional or trade association or trade union;
• religious beliefs or affiliations or philosophical beliefs;
• sexual preferences or practices;
• criminal record; or
• health, genetic information or disability.

If it is reasonably necessary in the circumstances, Bowls New Zealand may also collect sensitive information such as a person's medical history, nationality, their ethnic background or disabilities.
Bowls New Zealand is required by law to obtain consent when collecting sensitive information.
Bowls New Zealand will assume consent to the collection of all sensitive information that is provided to it for use in accordance with this Privacy Policy, unless told otherwise.

How does Bowls New Zealand collect personal and sensitive information?
Information may be collected when you:

(a) become a member of a bowls club, centre or other body which is a member of, or affiliated with, Bowls New Zealand
(b) subscribe to any publication of Bowls New Zealand, including electronic publications;
(c) provide details to Bowls New Zealand in an application, consent form, survey, feedback form or incident report;
(d) provide details to Bowls New Zealand when signing up for coach development courses;
(e) enter personal information into, or agree to having your personal information entered into, one of Bowls New Zealand's online systems;
(f) access the Bowls New Zealand website;
(g) contact Bowls New Zealand via email, telephone, fax or mail or engage with Bowls New Zealand via social media;
(h) participate in any program, activity, competition or event run by Bowls New Zealand;
(i) purchase tickets to a bowls, or other sporting, event from Bowls New Zealand or an authorised agent;
(j) purchase tickets to a social event (such as an awards night) from Bowls New Zealand or an authorised agent;
(k) purchase merchandise, products or services from Bowls New Zealand or an authorised agent or licensee;
(l) are elected or appointed to the Board or a committee of Bowls New Zealand;
(m) apply for employment or a volunteer position with Bowls New Zealand; or
(n) where Bowls New Zealand is required to do so by law (for education, child protection, work health and safety laws, charitable collections, medical treatment or other legislation in New Zealand).

Providing information
Depending on the circumstances, some types of information will be required and others might be optional. If you do not provide some or all of the information requested, this may affect Bowls New Zealand's ability to communicate with you or provide the requested products or services.
By not providing requested information, you may jeopardise your ability to participate in programs or competitions or apply for employment or volunteer positions with Bowls New Zealand. If it is impracticable for Bowls New Zealand to deal with you as a result of you not providing the requested information or consent, Bowls New Zealand may refuse to do so.

Collection from third parties
Bowls New Zealand may collect personal information regarding a child from the parent or other responsible person associated with that child.
In some circumstances, Bowls New Zealand collects information from Organisations affiliated to Bowls New Zealand, or other third parties.
Examples of such third parties could include, without limitation, Sport New Zealand, non-affiliated bowls organisations or government and law enforcement bodies.

Information storage and protection
Bowls New Zealand stores information in different ways, including in paper and electronic form. Much of the information we collect from and about our members is added to Bowls New Zealand's membership database. When your information is entered into Bowls New Zealand’s membership database, the information may be combined or linked with other information held about you. Bowls New Zealand's membership database may be shared among Bowls New Zealand, its Centres and its clubs, with each organisation only having access to information relevant to its members.
Security of personal information is important to Bowls New Zealand. Bowls New Zealand has taken steps to protect the information we hold from misuse, loss, unauthorised access, modification or disclosure. Some of the security measures Bowls New Zealand uses includes strict confidentiality requirements of our employees, volunteers, and service providers, security measures for system access and security measures for our website.

How does Bowls New Zealand use and disclose personal and sensitive information?

Use

Bowls New Zealand, and third parties to whom we may disclose personal information in accordance with this Privacy Policy, may use your personal information to:
(a) verify your identity;
(b) complete background checks;
(c) research, develop, run, administer and market competitions, programs, activities and other events relating to bowls;
(d) research, develop and market products, services, merchandise and special offers made available by us and third parties;
(e) respond to emergency situations involving or requiring medical treatment;
(f) administer, manage and provide you with access to www.bowlsnewzealand.co.nz
(g) administer and manage our membership database; and
(h) keep you informed of news and information relating to various bowls events, activities and opportunities via various mediums.

Bowls New Zealand may use health information to ensure that programs we operate are run safely and in accordance with any special health needs participants may require. Health information may also be kept for insurance purposes. In addition, we may use de-identified health information and other sensitive information to carry out research, to prepare submissions to government, or to plan events and activities.

Disclosure

Bowls New Zealand may disclose your personal information to a range of organisations which include, but are not limited to:
(a) Organisations associated to Bowls New Zealand and involved in bowls programs in New Zealand;
(b) companies we engage to carry out functions and activities on Bowls New Zealand's behalf, including direct marketing;
(c) our professional advisers, including our accountants, auditors and lawyers;
(d) our insurers;
(e) relevant sporting bodies such as World Bowls and Sport New Zealand, various National Sporting bodies amongst others; and
(f) in other circumstances permitted by law.

In some circumstances, personal information may also be disclosed outside of New Zealand - for example personal information is disclosed to World Bowls which is located in Scotland.
In such circumstances, Bowls New Zealand will use its best endeavours to ensure such parties are subject to a law, binding scheme or contract which effectively upholds principles for fair handling of the information that are suitably similar to the New Zealand Privacy Principles.

Direct marketing
We will assume consent to use non-sensitive personal information to provide better services and for marketing purposes (including disclosure of such information to service providers). Every person whose data is collected by Bowls New Zealand has the option to refuse e-mail, SMS or posted offers by making a request in writing to Bowls New Zealand via the contact details set out below or by making use of the opt-out procedures included in any communications from us (however, information relating to the option to unsubscribe from those communications may be retained).

Other disclosures
In addition, Bowls New Zealand may also disclose personal information:
(a) with your express or implied consent;
(b) when required or authorised by law;
(c) to an enforcement body when reasonably necessary; or
(d) to lessen or prevent a threat to an individual or public health or safety.

Bowls New Zealand website
When users visit the Bowls New Zealand website, our systems may record certain information about their use of the site, including the web pages visited and the time and date of their visit. Bowls New Zealand uses this information to help analyse and improve the performance of the Bowls New Zealand website.
In addition, we may use “cookies” on the Bowls New Zealand website. Accessing and seeking correction of information held by Bowls New Zealand
Bowls New Zealand will take all reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up to date. However, we rely on the accuracy of personal information as provided to us both directly and indirectly.
We encourage all users to regularly review and update their personal information. If you would like to access personal information that we hold about you, we require you to put your request in writing. If we do not allow you access to any part of the personal information we hold about you, we will tell you why.
Individuals may also request access to their personal information held by us by making a request via the contact details set out below.
We will respond to your request for access within 14 days and refer your request to your club or bowls organisation to provide the requested information. Your club or bowls organisation will endeavour to provide the requested information within 60 days.
If you do not receive the requested information, you should notify Bowls New Zealand. If you find that the personal information we hold about you is inaccurate, incomplete or out-of-date, please contact us immediately and we will arrange for it to be corrected.

Resolving privacy issues and complaints
Any issues or complaints in relation to the collection, use, disclosure, quality, security of and access to your personal information may be made in writing to Bowls New Zealand at this address:

In order to maintain the confidentiality of your personal information, we may ask you to visit the Bowls New Zealand office and to bring with you specific identification before we give you access. If it is not possible for you to visit our office, we will arrange to check your identification before we mail the information to you.
We will respond to your complaint within 60 days and try to resolve it within 90 days. If we are unable to resolve your complaint within this time, or you are unhappy with the outcome, you can fill out the online complaints form for the Privacy Commissioner of New Zealand here. Bowls New Zealand may amend this Privacy Policy from time to time.

Website Terms and Conditions

The Bowls New Zealand Incorporated (“Bowls New Zealand”) website (“Bowls New Zealand Website”) and all the websites within the Bowls New Zealand network (including but not limited to those of Centres and Clubs) shall be collectively known as the “Websites”.
These terms and conditions cover the use of the Websites. Bowls New Zealand reserves the right, at its sole discretion, to modify these terms and conditions from time to time. Use of the Websites constitutes agreement of the terms and conditions by the users of the Websites.

Public Forum
The Websites may provide an area, site or feature which offers the opportunity for users to publish submissions for viewing by other Website users, including but not limited to a chat area, message board or profile page ("Public Forum").
It is a condition of use of the Websites that all users are and remain solely responsible for any submissions that they publish or distribute. Persons under the age of 18 years must obtain their parents or guardians permission before submitting any content on the Websites. Bowls New Zealand cannot guarantee the privacy or security of any information published or distributed through a Public Forum.
Bowls New Zealand has no duty to monitor any Public Forum, however Bowls New Zealand does reserve all rights to edit, remove or otherwise deal with any material which is published or distributed through a Public Forum or otherwise on the Websites. Bowls New Zealand is not responsible for, and it does not endorse, the opinions, advice or recommendations posted or sent by users in any Public Forum and Bowls New Zealand specifically disclaims any and all liability in connection with any Public Forum.

Ownership of user submitted content remains with the user
Bowls New Zealand does not claim ownership rights in any text, files, images, musical works, works of authorship or any other materials (collectively, "Content") that is displayed, published, submitted or uploaded (collectively, "submitted") by you on or through the Websites. You will retain all ownership rights in such submitted Content and are responsible for protecting such rights as appropriate.

Exclusive license granted to Bowls New Zealand
By submitting any Content on or through the Websites, you grant to Bowls New Zealand an unlimited exclusive license to use, copy, cache, modify, perform, publicly display, reformat, translate, excerpt (in whole or in part), reproduce and distribute the Content for any purpose, whether commercial, advertising or otherwise, in connection with Bowls New Zealand or the sport of Bowls, or the promotion thereof, including the right to distribute the Content outside of the Bowls New Zealand Website. This includes use of the Content in the preparation of derivative works, or incorporation into other works and the grant of sublicenses of the foregoing.
This license is irrevocable, perpetual, exclusive, fully paid and royalty free, sublicensable and fully transferrable and worldwide.
You agree that this license includes a right for Bowls New Zealand to sublicence or make such Content available to other persons with whom Bowls New Zealand has relationships for the provision of joint services or otherwise.
To the extent permitted by law, the foregoing includes all rights of paternity, integrity, disclosure and withdrawal and any other rights that may be known as or referred to as moral rights. To the extent you retain any such moral rights under applicable law, you hereby ratify and consent to any action that may be taken with respect to such moral rights.

Warranty
You represent and warrant that:

• you own any Content that is submitted by you, or otherwise have the rights, power and authority to grant the licence provided in accordance with these terms and conditions;
• Content submitted by you on or through the Websites does not infringe, violate or otherwise interfere with any copyright, trademark or intellectual property rights of another party including rights arising in relation to trade secrets and any moral rights;
• nothing you submit on or through the Website is libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, offensive or otherwise violates any law or right of any third party;
• the submission of Content by you on or through the Websites does not affect any privacy rights, publicity rights, trade secrets, contract rights or any other rights of any third persons;
• you agree to pay for all royalties, fees and other amounts owing to any person by reason of the Content submitted by you to or through the Website;
• you will under no circumstances use the site or the service to send unsolicited e-mails, bulk mail, spam or other materials; harass, threaten, stalk or abuse any person or party or post any false, inaccurate or incomplete material.

Content posted
Bowls New Zealand may, but is not obligated to, delete any Content posted on the Websites that in the sole judgement of Bowls New Zealand violates these terms and conditions or which may be offensive, illegal or violate the rights, harm or threaten the safety of any person. Bowls New Zealand assumes no responsibility for monitoring the Websites for inappropriate Content or conduct.
Bowls New Zealand has no control over, and no duty to take any action regarding, who gains access to the Websites or the effect of its content. Bowls New Zealand takes no responsibility for Content which may be considered offensive or inappropriate and Bowls New Zealand will not be responsible or liable for the accuracy, copyright compliance, legality or decency of material contained in or accessed through the site.
Limitation of Liability
In no event shall Bowls New Zealand, or its officers or employees, be liable with respect to the Websites for any:

• indirect, incidental, punitive, or consequential damages of any kind whatsoever;
• damages for loss of use, profits, data, images, user submitted Content or other intangibles;
• damages for unauthorised use, non-performance of the site, errors or omissions; or
• damages related to downloading or posting Content.

Bowls New Zealand excludes all implied conditions and warranties regarding the site and the services, except any implied condition or warranty the exclusion of which would contravene any statute or cause any part of these terms and conditions to be void ("Non-Excludable Condition").
To the extent permitted by law, Bowls New Zealand’s liability to you for breach of any Non-Excludable Condition is limited, at Bowls New Zealand’s option (as the case may be), to supplying the services in respect of which the breach occurred again, or payment of the cost of having those services supplied again.

Bowls New Zealand may collect information through the Websites. Bowls New Zealand respects the privacy of the individuals of whom it collects, uses, discloses and holds personal information.
Bowls New Zealand has a Privacy Statement that is based on the National Privacy Policy Principles contained in the Privacy Act 2020.
Bowls New Zealand uses the information it collects for a range of purposes including, but not limited to, to administer and promote Bowls in New Zealand, and to provide related services and activities, to register, select and insure participants, and to assess the level of interest in Bowls New Zealand.
